State Mandated Manager Training

In 2005, the state legislature mandated that Managers of Mobile Home Parks must receive six hours of management training every two years, via a state approved instructor for park manager continuing education.  Issues of training include landlord tenant law,  accommodations for individuals with disabilities, and laws barring discrimination. 

How do you find out if YOUR manager is in compliance with this mandate?  Quite simply, ask to see his certificate of continuing education, which is provided by the instructor upon the completion of the course.  Also, you could check online and the Oregon Housing and Community Services Department website.  However, the list may not be 100% accurate, as it is currently under construction…

Two Parks In Oregon Have Become Resident Owned Communities!

So far, we have joyfully witnessed two successful MHP conversions into resident owned communities.  They are Springlake Community in Scappoose, and Lake Shore Estates in Linn County.  These conversions were facilitated by Dean Sargeant of PMC Financial Services.  Also, a third park in MacMinnville, is in the early phases of purchasing their park, using a Limited Equity ROC approach.  This conversion is being assisted by CASA of Oregon through the I’M HOME Initiatiave. 

What Is A Binding Arbitration Clause?

Mobile home park rental agreements, especially within the past ten years, tend to contain these.  The clause requires the mobile home resident to use binding arbitration procedures to settle disputes with park owners and managers rather than pursue these issues through legal actions such as lawsuits.  California legislature has consistently found these laws to be unconstitutional, since the resident is afforded no real means of negotiation with the manager and the results of the “binding arbitration” prohibit any legal remedy to be sought by the tenant.  Such repeated findings in the CA courts could be considered very persuasive argument in OR litigation.  We’ll keep it on our radar.
